The rules and guidelines governing the use of BikeModifier's 3D studio, digital assets, and visualization tools.
1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and BikeModifier ("we", "us", or "our"), concerning your access to and use of the BikeModifier website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
You agree that by accessing the platform, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the platform and you must discontinue use immediately.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and our 3D configurator—including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and specifically all highly-detailed 3D motorcycle models and aftermarket parts (collectively, the "Content")—are owned or controlled by us or licensed to us.
Strictly Prohibited Uses
- Extracting, downloading, or scraping 3D model geometry or texture files.
- Using the platform's assets for commercial rendering, advertising, or resale.
- Reverse engineering the WebGL viewer or material compilation processes.
The Content is provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms, no part of the Site and no Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
3. Customization Accuracy
BikeModifier provides a state-of-the-art 3D studio for visual modification of motorcycles. While we utilize physically based rendering (PBR) to accurately simulate paint finishes, carbon fiber, metals, and real-world lighting, these are digital representations.
Please Note:
- Physical paint colors (e.g., Matte Black, Rosso Red) may appear differently in real life under varying lighting conditions compared to a calibrated digital screen.
- Aftermarket parts (exhausts, windshields, seats) are modeled for visual compatibility. This does not guarantee physical fitment, road legality, or mechanical safety on a real motorcycle.
- Always consult with a certified mechanic or the original manufacturer before making physical modifications to your motorcycle.
4. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the platform, even if we have been advised of the possibility of such damages.
Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.
5. Modifications & Interruptions
We reserve the right to change, modify, or remove the contents of the platform at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the platform.
We cannot guarantee the platform will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors.
